Basketball Program Terms & Conditions, Waiver, Release of Liability & Parental Consent Agreement

1. INTRODUCTION

Welcome to Generation Guard Foundation (“GGF,” “we,” “our,” or “the Organization”). By registering for or participating in any Generation Guard Foundation basketball-related activity, event, clinic, or program, participants and/or their parent/legal guardian agree to comply with these Terms & Conditions, Waiver, Release of Liability, and Hold Harmless provisions.

2. ELIGIBILITY & REGISTRATION
  • All participants must complete registration forms fully and accurately.
  • Participants under the age of 18 must have this agreement reviewed and signed by a parent or legal guardian.
  • Participants may be required to provide emergency contact information, relevant medical details, and consent forms before participating.
  • Generation Guard Foundation reserves the right to deny or revoke participation where safety, conduct, or incomplete documentation is a concern.
3. PARTICIPANT CODE OF CONDUCT

All participants agree to:

  • Treat coaches, volunteers, staff, officials, and fellow participants with respect
  • Follow all facility, court, and program rules
  • Use equipment responsibly
  • Refrain from bullying, harassment, violence, discrimination, or unsafe conduct
  • Wear appropriate athletic attire and footwear

Generation Guard Foundation reserves the right to suspend or remove participants without refund (where applicable) for misconduct, unsafe behavior, or repeated policy violations.

4. HEALTH DISCLOSURE & FITNESS TO PARTICIPATE

By participating, the participant and/or parent/legal guardian confirms that:

  • The participant is physically capable of engaging in basketball activities
  • Any relevant medical conditions, injuries, allergies, or limitations have been disclosed
  • Participation is voluntary
  • The participant assumes responsibility for monitoring their own physical condition during activities

Generation Guard Foundation may restrict participation where health or safety concerns arise.

5. ASSUMPTION OF RISK

Basketball and related physical activities involve inherent risks, including but not limited to:

  • Falls
  • Collisions
  • Physical contact
  • Sprains, strains, fractures
  • Concussions
  • Illness or medical emergencies
  • Property damage

By participating, participants and/or parents/legal guardians knowingly and voluntarily assume all such risks, whether known or unknown.

6. WAIVER, RELEASE OF LIABILITY & HOLD HARMLESS AGREEMENT

In consideration for participation, the participant and/or parent/legal guardian agrees to:

  • Release Generation Guard Foundation, its founders, directors, officers, coaches, volunteers, staff, sponsors, facility providers, affiliates, and partners from all claims, liabilities, damages, losses, costs, or expenses arising from participation
  • Waive the right to legal action against released parties for injuries, losses, or damages except where prohibited by law
  • Indemnify and hold harmless Generation Guard Foundation and all affiliated parties from claims caused by participant actions or negligence

This release applies to personal injury, illness, property damage, or other claims arising before, during, or after participation.

7. MEDICAL CONSENT & EMERGENCY AUTHORIZATION

In the event of injury or emergency:

  • Generation Guard Foundation representatives may seek emergency medical care on behalf of the participant if immediate contact cannot be made
  • Parent/legal guardian authorizes such care
  • Participant/guardian accepts financial responsibility for medical treatment

Generation Guard Foundation does not guarantee on-site medical personnel unless explicitly stated.

8. INSURANCE ACKNOWLEDGMENT

Generation Guard Foundation may maintain general liability insurance; however:

  • This does not replace personal accident, health, dental, or medical insurance
  • Participants are encouraged to maintain their own insurance coverage
9. PHOTO, VIDEO & MEDIA RELEASE

Unless otherwise declined in writing, participants and/or parents/legal guardians grant Generation Guard Foundation permission to use photos, video recordings, testimonials, or media containing the participant’s likeness for:

  • Promotional campaigns
  • Social media
  • Fundraising
  • Educational materials
  • Grant reporting

No compensation is required for such use.

10. PRIVACY POLICY

Generation Guard Foundation will make reasonable efforts to protect participant personal information and use collected information solely for:

  • Registration
  • Safety
  • Program operations
  • Insurance compliance
  • Legal obligations

Information will not be intentionally sold or misused.

11. REFUND / CANCELLATION POLICY

For paid events (if applicable):

  • Administrative fees may be non-refundable
  • Refund eligibility may depend on timing, program expenses, or extraordinary circumstances
  • Generation Guard Foundation reserves the right to cancel or modify programs due to facility issues, safety concerns, weather, staffing, or insufficient enrollment
12. GOVERNING LAW

This agreement shall be governed by the laws of the Province of Ontario and the applicable laws of Canada.

13. SEVERABILITY

If any provision of this agreement is deemed unenforceable, all remaining provisions shall remain in full force.
